1.SECTION 302 IPC BARE ACT:

English;

✒️Whoever commits murder shall be punished with death, or imprisonment for life, and shall also be liable to fine.

Tamil Translation;

✒️யார் ஒருவர் ஒருவரை கொலை செய்தால், அவருக்கு மரண தண்டனை அல்லது வாழ்நாள் சிறை தண்டனை (ஆயுள் தண்டனை) மற்றும் அபராதம் விதிக்கப்படும் -  Yaar oruvar oruvarai kolai seidhal, avarukku marana thandanai alladhu vazhnaal sirai thandanai (Ayul thandanai), matrum abaratham vithikkapadum.

3 Key Elements to Prove Murder:

1.  Death of a Human Being - Medical Report.
2.  By the Act of Accused - Direct Link.
3.  With Intention - Section 300 IPC.

2.PUNISHMENT UNDER SECTION 302 IPC :

Court ku 2 options irukku;

1. Death Penalty - "Rarest of Rare Case" la mattum. Supreme Court sonnadhu: Bachan Singh vs State of Punjab 1980.

2. Imprisonment for Life - Normal murder cases. Life means till last breath. But Govt can remit after 14 years.

3. Fine - abaradham amount Court decide pannum.

Tamil Example;

🌟Plan panni kudumbam motham kolai - Rarest of Rare = Death.

🌟Kovathula oru kuthu - Normal Murder = Life.

3.RAREST OF RARE DOCTRINE :

Death penalty eppodhu? Machhi Singh vs State of Punjab 1983 case la 5 points sonnanga;

1.  Manner of murder - Very brutal.
2.  Motive - Very depraved.
3.  Magnitude - Many people.
4.  Victim - Child, Police, Public Servant.
5.  Personality of Victim - No provocation.

⚖️ Important: Death Penalty in Section 302 IPC

Section 302 la Life or Death rendu punishment um iruku. Aana Judge yaarukum random ah death kuduka mudiyadhu.

1980 Bachan Singh vs State of Punjab case la Supreme Court "Rarest of Rare" nu oru guideline set pannierukkanga.

Death varanum na idhu irukanum:

  1. Crime: Kolai romba kodurama, brutal ah, society ku danger ah irukanum.
  2. Criminal: Accused reform aagave mudiyadhu nu theriyanum.
  3. Reason: Judge death ku "special reason" nu writing la sollanum - CrPC Sec 354(3)

Result: Life Imprisonment dhan Rule. Death dhan Exception.

Example: Nirbhaya case 2012, Kasab case - idhu lam "Rarest of Rare" la vandhadhu.

5. DIFFERENCE: IPC 302 vs 304 vs 307

❓ Frequently Asked Questions - FAQ

Q1: Can bail be granted in Section 302 IPC? 
A: No. It is a non-bailable and cognizable offence. Only High Court or Session Court can grant bail in special circumstances. 

Q2: What is the difference between 302 and 304 Part 1? 
A: 302 = Intention to kill. 304 Part 1 = Intention to cause bodily injury that causes death. Punishment in 304 is less.

Q3: Is Life Imprisonment 14 years or till death? 
A: As per law, Life means till death. But Section 432 CrPC allows Govt to remit after 14 years.
